TERMS AND CONDITIONS - TRADE AND CORPORATE EVENTS
If you decide to employ Corabar Entertainment to supply mobile discothèques and DJs for your Event(s), we will send you a Booking Form for signature. The Booking Form will incorporate our Terms and Conditions and by an officer of your Company / Organisation signing the Booking Form, your Company / Organisation will be entering into a legally binding Contract and agreeing to abide by our Terms and Conditions as follows:-
- In these Terms and Conditions you are hereinafter referred to as the PROMOTER, and Corabar Limited, trading as Corabar Entertainment, is hereinafter called the DISCOTHEQUE. The Promoter engages the Discotheque, and the Discotheque accepts the engagement to appear at the venue on the date and times and for the fee as shown in the Booking Form subject to these Terms and Conditions.
- A non-refundable booking deposit, of the amount specified in the Booking Form, must be submitted with the signed copy of the Booking Form.
- In the case of a multiple or indefinite booking, the deposit will be treated as a rolling deposit for the duration of this Contract and deducted from the fee payable for the final event undertaken by the Discotheque for the Promoter.
- The balance of the booking fee, as specified on the Booking Form, should be paid by the Promoter to the Discothèque in cash or by company cheque no later than the date of the event, but preferably at least seven days prior to the event.
- The total fee quoted is in respect of a performance during the times specified in the Booking Form. If the Promoter requests that the performance time be extended, then the additional period and fee must be agreed with the Disc Jockey provided by the Discotheque, and either
i) paid in cash prior to the start of the performance extension, or
ii) a supplementary Contract must be signed by a duly authorised signatory of the Promoter agreeing to the additional charge, and a company cheque forwarded to the Discothèque to cover the additional charge within 3 working days following the performance.
- In the event of late payment of the fees payable to the Discothèque by the Promoter – whether for the original fee quoted or the fee for any performance extension, the Discothèque reserves the right to charge interest on such outstanding amounts at the rate of 4% per annum above the base rate from time to time in force of National Westminster Bank plc for the period from the date such sums became due until the date cleared funds are received for such outstanding amounts.
- Fees quoted per event for multiple and indefinite bookings do not apply to Christmas Eve, Christmas Day, Boxing Day, New Year’s Eve, and New Year’s Day for which a separate contract will need to be negotiated and signed between the parties.
- In the case of an indefinite booking, the Contract may be determined by either party giving to the other not less than one-month’s notice in writing.
- In the event of cancellation of a particular performance (as opposed to determination of the Contract in accordance with the preceding paragraph), a cancellation fee will be made on the following basis:
i) Cancellation advised in writing, received more than seven days before the event date - loss of deposit only
ii) Cancellation advised within seven days of the event date will lead to the full fee becoming payable immediately.
Due to the exceptional nature of Christmas Eve and New Years Eve, these time limits will be extended to fourteen days.
- When a booking has been formally cancelled, and that cancellation has been accepted by both parties, the Promoter forfeits any rights to use the services of the Discotheque on that date, irrespective of deposits or cancellation fees paid.
- The Promoter must ensure that the Disc Jockey has access to two 13 amp 240 volt sockets at the Disc Jockey’s working position. The working position must not obstruct any emergency exit route, and must allow enough space for the Disc Jockey to operate in comfort and safety. The equipment should not be placed directly onto a dance floor to avoid vibration damage.
- The Discotheque will supply sufficient music to suit the occasion; adequate equipment for playing and amplifying recorded music; lighting and other effects to suit the occasion and venue; a Disc Jockey and where deemed necessary an assistant.
- The Promoter is responsible for the behaviour of his / her clients or guests, and for safeguarding the Disc Jockey and equipment against theft, damage or other risks, from the moment of arrival to the moment of final departure. Please note, any loss of or damage to equipment, other than that caused by fair wear and tear, will be charged for.
- The Discotheque can not be held responsible for the way some people may be affected by strobe lighting or any other lighting, sound or haze effect that may be used. The Promoter must advise the Disc Jockey prior to the start of the performance if any effect should be avoided.
- The Disc Jockey provided will generally be an employee of the Discotheque, or a self employed Disc Jockey working exclusively for the Discotheque. The Discotheque reserves the right however to assign the engagement to a suitably experienced and qualified associate.
- The Disc Jockey shall be deemed to be under the direction and control of the Promoter, and shall be regarded as a servant or agent of the Promoter, and the Promoter shall be responsible for any claims arising from placement or operation of the equipment.
- The Promoter will be responsible for obtaining all necessary licences and permissions relating to the performance(s) at the event(s).
- The Discotheque operates regularly serviced and maintained good quality sound and lighting equipment. In the rare event of any equipment failure, an on site repair will be attempted. If however there is an irreparable breakdown in lighting a partial refund will be given. If there is an irreparable breakdown in sound a full refund will be given.
- The Discotheque shall be entitled to terminate this contract without liability if for any reason beyond its control the Disc Jockey is unable to perform, due to fire or theft of equipment, illness or breakdown of vehicle. The Discotheque will use all reasonable endeavours to locate a replacement Disc Jockey, but, in the unlikely event of a non performance all monies paid will be refunded, but this will be the limit of our liability to you.
